Oracle Gets Another Setback In Google Dispute

NEW YORK ? Oracle Corp. received another setback Thursday as a federal judge in San Francisco undermined a central part of the company's multimillion dollar case against Google Inc. over its Android software for mobile devices.

Oracle had accused Google of copyright infringement in using "application programming interfaces," or APIs, that help Oracle's Java software work effectively. A jury found Google infringed on those APIs on May 7, but it couldn't agree on whether Google was covered under "fair use" protections in U.S. law. Without a fair-use determination, Oracle wasn't able to extract huge sums from Google.

Now, U.S. District Judge William Alsup said Google's use of the APIs wasn't covered by copyright law in the first place.

The effect of Thursday's ruling is limited because a jury had earlier reached an impasse on the issue of fair use. But the ruling could be important in any appeals.

Oracle said it will appeal the ruling.

Android now powers more than 300 million smartphones and tablet computers. Those devices are the chief competitors to Apple's iPhones and iPads. Google has driven the adoption of Android by giving the software away to manufacturers of phones and tablets. That would have been more difficult for Google to keep doing if the court had found that Google needed to pay Oracle millions of dollars to license Java technology.

The jury in the case had been asked to rule on the infringement and fair use questions on the assumption that the APIs were copyrightable. Alsup deferred a ruling on the broader copyright question until after the trial, which ended May 23.

Alsup ruled Thursday that Google didn't use Oracle's exact programming code in Android, but rather wrote its own code to produce the same functions. Although Google used some of the same phrases in the code, Alsup said it had to do so to maintain interoperability. Names, titles and short phrases aren't covered by copyright, and Google's use of those phrases amounted to that, he said.

"In sum, Google and the public were and remain free to write their own implementations to carry out exactly the same functions of all methods in question, using exactly the same method specifications and names," Alsup said.

In a statement, Google said "the court's decision upholds the principle that open and interoperable computer languages form an essential basis for software development. It's a good day for collaboration and innovation."

Oracle countered that Alsup's ruling would "make it far more difficult to defend intellectual property rights against companies anywhere in the world that simply takes them as their own."

Alsup's ruling does not affect the jury's determination that Android infringed on nine lines of Java coding, but the penalty for that violation is confined to statutory damages no higher than $150,000. Oracle had been seeking hundreds of millions of dollars from Google on the API questions.

The jury has also cleared Google of infringing two Oracle patents.

I've just spent the weekend in Sydney for my little sister's baby shower!? Isn't she the cutest?!? And at 35 weeks has the best little bump ever!

It was so lovely to spend the weekend with my Mum and two sisters.? We are all so alike, yet very different and our personalities definitley compliment each other.? I remember when Dad had a stroke (which we thought was a heart attack at the time) and we were all at Mum & Dad's house for the Christmas holidays.? Mum went to the hospital with Dad, leaving us girls at home...it is hilarious to look back at our coping mechanisms: Carli - non-stop talking, making absolutely no sense.? I whipped out the vacuum cleaner and proceeded to clean the house from top to bottom because I didn't want Mum to have to come home to any housework and Filipa sat on the couch and cried!? See what I mean about complimenting each other beautifully - at least we weren't all fighting over the vacuum cleaner!

Filipa is a pure delight and always has been the lovely one of the family.? And you could tell just how many people really do love her from the large gathering and lots of hugs and laughter at her baby shower.

Apart from the baby shower, we also went out for a delicious "girls only" dinner and ate way too much in our three course dinner that finished off with musical plates circulating around the table so that we could sample each others dessert!? On Sunday night we visited the spectacular light show, Vivid Sydney and were awed by the amazing artistic transformation of the city.? And Saturday saw us taking a trip to North Head lookout.? The view of the city was out of this world.?
?And I'm not joking when I tell you it was one of the most windy days I've experienced in a long time...
?It made us all go a little crazy!

Apple just confirmed that?its keynote event?will take?place on Monday, June 11,?during?the company's annual Worldwide Developers Conference (WWDC).?As usual, expectations are high ? the event potentially?brings a new product?announcement?or two.

The keynote will take place at 10 a.m. PT/1 p.m. ET on June 11. Apple typically kicks WWDC off with such an event, so no one's surprised by its appearance on the WWDC schedule. Instead, the focus is on whether or not a new product will be announced when?Apple CEO Tim Cook steps onto a stage in San Francisco, California two weeks from now.

As I've explained when I reviewed what we can expect to hear from Apple, both at WWDC and for the rest of the year, the Cupertino-based company is prone to releasing major iOS updates during the summer.?And besides, WWDC ??as its name implies ??is a global crossroads for Mac and iOS developers, and generally focuses on software, rather than hardware. So, if I were placing?bets on what will be announced at WWDC 2012, I'd put my big money on iOS 6.

Of course ??with the exception of the iPhone 4S ??every new iPhone model hit the?shelves in either June or July. This pattern has many believing that the next-generation Apple smartphone will be announced during WWDC.?Unfortunately for those hopeful folks,?most recent reports shoot down the idea?that the next iPhone will make an appearance on that day.

There hasn't been a week during the month of May where I haven't attended a tech conference or traveled to something tech conference-related. And judging by Techmeme's events calendar the state of affairs only gets worse as we get deeper into summer. Wells Fargo Mortgage Rates Today: More Record-Lows Ahead? Most of the mortgage rates on offer today at Wells Fargo (NYSE:WFC) are among the lowest ever seen in recorded history and represent astonishing value for the borrower. Are Eyewitnesses in the Zimmerman Trial Reliable?

Newly released court documents in the second-degree-murder case against neighborhood watch volunteer George Zimmerman reveal that, in the month following his fatal shooting of Trayvon Martin on Feb. 26, four key witnesses significantly changed their accounts of what they saw and heard that night. The more recent versions of their memories tend to be more damning of Zimmerman than their initial statements.

Which raises the question: How reliable are eyewitnesses?

For example, days after the shooting, one woman told police she had seen two men running through the streets and then engaging in a fistfight. Less than one month later, she told investigators she saw just one person running, and couldn't describe his or her appearance as she hadn't had her contact lenses in at the time.

Another witness, who was initially interviewed March 20, said she saw two people on the ground immediately after the shooting but was not sure which one was on top. In another interview with investigators six days later, she said it had definitely been Zimmerman on top, explaining that she was sure because she had been able to compare Zimmerman's and Martin's sizes after seeing them on TV.

A third witness originally said he saw a black man (presumably Martin) pinning down and punching a lighter-skinned man (Zimmerman) who was calling for help. Later, the witness wasn't sure any punches were thrown or that he had heard distress calls.

And a man who initially described Zimmerman as looking bloody and in shock after the shooting later implied the shooter had been calm, cool and collected.

Why do people's memories change over time? And which versions of these witnesses' stories are to be believed ? the earlier ones untarnished by time, or the later ones, perhaps less sullied by what may have been false impressions imbued early on by news reports or police interviewers?

The reliability of witness testimony is a vastly complex subject, but legal scholars and forensic psychologists say it's possible to extract the truth from contradictory accounts and evolving memories. According to Barbara Tversky, professor emerita of psychology at Stanford University, the bottom line is this: "All other things equal, earlier recountings are more likely to be accurate than later ones. The longer the delay, the more likely that subsequent information will get confused with the target memory."

However, in some cases not all other things are equal.

How we remember

Memory is a reconstructive process, says Richard Wise, a forensic psychologist at the University of North Dakota. "When an eyewitness recalls a crime, he or she must reconstruct his or her memory of the crime." This, he says, is an unconscious process. To reconstruct a memory, the eyewitness draws upon several sources of information, only one being his or her actual recollection.

"To fill in gaps in memory, the eyewitness relies upon his or her expectation, attitudes, prejudices, bias, and prior knowledge. Furthermore, information supplied to an eyewitness after a crime (i.e., post-event information) by the police, prosecutor, other eyewitnesses, media, etc., can alter an eyewitness's memory of the crime," Wise said in an email. That external input is what makes eyewitness testimony so unreliable. Eyewitnesses are generally unaware that their memory has been altered by post-event information, and feel convinced they're recalling only the incident itself. "Once an eyewitness's memory of the crime has been altered by post-event information, it is difficult or impossible to restore the eyewitness's original memory of the crime," Wise told Life's Little Mysteries.

No. 17 Virginia Baseball Falls To Georgia Tech In ACC Tournament

The No. 17 Virginia baseball team lost 17-5 to No. 8 seed Georgia Tech Friday afternoon at the ACC Baseball Championship at NewBridge Bank Park in Greensboro, N.C. The game was halted in the seventh inning because of the tournament's 10-run mercy rule. The No. 4 seed in the tournament, Virginia (37-17-1) is now 1-1 in pool play.

UVa concludes pool play at 3 p.m. Saturday when it takes on top-seeded Florida State.

Colin Harrington (R-So., Johnstown, Pa.) tied a career high with three hits for the Cavaliers, while Derek Fisher (Fr., Rexmont, Pa.) and Branden Cogswell (Fr., Ballston Lake, N.Y.) each added a pair of hits. Zane Evans went 3-for-4 with six RBI to highlight a big offensive day for Georgia Tech (34-24).

UVa starting pitcher Scott Silverstein (R-Jr., Olney, Md.) took the loss for UVa and fell to 2-5 after allowing four earned runs, four hits and a walk in 2.1 innings. Cole Pitts (6-4) notched the win for Georgia Tech after allowing four runs (two earned) in five innings.

The Yellow Jackets' 17-run performance easily marked the most runs allowed by Virginia this year. The Cavaliers surrendered 12 runs in a March 17 loss at Florida State. UVa had not allowed more than six runs in any of its previous 25 games.

Virginia bolted to an early 3-0 edge, with a pair of runs in the second and one in the third. In the second, Jared King (R-Jr., Radford, Va.) reached on a leadoff error. Harrington and Brandon Downes (Fr., South Plainfield, N.J.) hit back-to-back singles to bring in a run. After a sacrifice bunt by Nate Irving (Fr., Yonkers, N.Y.), Keith Werman (Sr., Vienna, Va.) laid down a squeeze bunt to bring Harrington home.

UVa added a run in the third. Fisher hit a leadoff single and stole second base. He scored on a one-out single to right by Harrington.

Georgia Tech sent 10 batters to the plate in a six-run third inning. Silverstein hit Connor Lynch with a pitch to start the inning, and Kyle Wren followed with a single. After a sacrifice bunt, Brandon Thomas singled to center to plate a pair of runs. Jake Davies doubled to knock Silverstein out, and Evans doubled against Nick Howard (Fr., Olney, Md.) to give the Yellow Jackets the lead. One out later Mott Hyde lined a home run to left field to push the Georgia Tech lead to 6-3.

The Yellow Jackets padded their lead in the fourth inning, scoring four times to move ahead 10-3. After Howard walked the first two batters, Wren and Sam Dove, Thomas lined a double down the right-field line to score a run. Howard intentionally walked Davies, and Austin Young (So., Mechanicsville, Va.) came on in relief. On Young's first pitch, Evans hit a scorcher off the glove of a diving Stephen Bruno (R-So., Audubon, N.J.) at third base, and two runs scored on the single. One out later Hyde hit a sacrifice fly.

Virginia cut a run from the lead in the fifth inning, getting singles from Harrington and Irving before Werman hit a run-scoring grounder to second base. UVa chipped away with another tally in the sixth, as Cogswell led off with a single, stole second and scored on a Fisher single.

Georgia Tech got those runs back in its half of the sixth when Evans went the opposite way for a two-run home to right field.

In the seventh inning Thomas Smith drew a leadoff walk and scored when Lynch doubled to left-center field. One out later Dove tripled to right-center to plate Lynch. After Thomas was hit by a pitch, Davies launched a three-run homer over the right-center field wall to trigger the mercy rule.

True, sanctions have gained greater support. European Union countries have agreed to halt oil imports from Iran by July 1. And Japan, South Korea, and Turkey may reduce their imports from Iran as well. However, China and India currently consume around 35 percent of Iran?s oil and appear reluctant to cut back. They may even buy more as other countries buy less and as they get better oil deals from Iran, which would undermine US-led sanctions to some degree.

Iran also consumes about 400,000 barrels per day of gasoline, and imports about 120,000 barrels per day. The imports come from many places, but China is an especially critical source. In January 2012, Washington sanctioned China?s state-run Zhuhai Zhenrong Corp., which it said was Iran?s largest gasoline supplier.

Sanctions may have put some pressure on Iran to come to the negotiating table, but much greater unity ? especially from China and India ? will be needed to help close the deal. Such changes are possible from most countries, but China and India will prove a huge challenge.

Markets swoon as anxiety about Europe takes hold

NEW YORK (AP) ? The threat of a financial crisis spreading from Europe shook markets on Wednesday. The euro dropped to a nearly two-year low against the dollar. Oil prices sank to their lowest this year, and stocks took another fall.

The Dow Jones industrial average fell 180 points to 12,322 shortly after noon Eastern. The Dow has lost 6.7 percent this month, nearly wiping away all its gains for the year. Energy, banks and technology stocks fell the most.

In Brussels, leaders of the 27 countries that make up the European Union met to discuss ways to keep the debt crisis in Europe from getting worse, including proposals to promote jobs and growth.

Analysts are turning increasingly skeptical that European leaders will succeed at preventing Greece from dropping the euro or agree on ways to jump-start the region's economy. The Organization for Economic Cooperation and Development warned Tuesday that the 17 countries that use the euro risk falling into a "severe recession."

Germany's DAX and France's CAC-40 closed more than 2 percent lower. The euro continued falling against the dollar, reaching $1.25, its lowest level since July 2010. Concerns about the stability of the European currency union if Greece leaves have knocked 5 percent off the euro this month. Yields on German government bunds fell as money shifted into low-risk investments.

If Greece exits, it could spread havoc throughout the global financial system. Bond traders may turn on other struggling governments in Spain and Italy. One big fear is that people in Spain and Italy will start a bank run, pulling euros out of banks for fear that their countries will soon follow Greece's lead. European banks have close ties to U.S. banks.

In other trading, the Standard & Poor's 500 index fell 19 points at 1,297. The Nasdaq composite index slumped 42 points to 2,796.

Benchmark crude lost $1.50 to $90.37 in New York. It fell as low as $90.18 earlier in the day. Prices haven't been below $90 since Nov. 1.

The dollar rose and yields on U.S. government debt fell as traders shifted money into the protection of Treasurys. The yield on the 10-year note sank to 1.71 percent, close to a record low, from 1.77 percent late Tuesday.

The dollar and Treasurys often trade in tandem when anxiety hits markets. Traders from around the world sell foreign assets and then need to buy dollars before buying dollar-denominated U.S. Treasurys.

Facebook climbed 3 percent to $32.10, its first gain after two tumultuous days. The stock is still well below the $38 price for its initial public offering last week.

Worries about Europe overshadowed encouraging news from the U.S. housing market.

The Commerce Department said sales of new homes rose solidly last month, adding to evidence of gradual improvement in the housing market. Americans bought 3.3 percent more homes in April, led by strong gains in Midwest and West.

Europe's struggles come at a time when Asia is also slowing. China's economic growth fell to a nearly three-year low of 8.1 percent in the first quarter and factory output in April grew at its slowest pace since the 2008 crisis, raising the threat of job losses and possible political tensions.

Other stocks making big moves included:

? Dell fell 17 percent. The computer maker reported disappointing first-quarter results after the market closed Tuesday and predicted weak sales for its second quarter. Quarterly profit fell 33 percent on lower sales to big businesses, consumers and the public sector.

? Ford Motor rose 1 percent, a day after the company won back its blue oval logo, factories and other assets that were pledged as collateral for a massive loan taken out last decade.

? Guess Inc. rose 4 percent after its first-quarter results beat Wall Street's expectations, and an analyst recommended that investors buy the stock.
